Agartala: A full bench of the Tripura High Court, headed by Chief Justice AK Singh, Justice T Amarnath Gaur, and Justice Arindam Lodh, rejected the plea of one of the 10,323 teachers, once again upholding their dismissal.
The case has been in controversy since 2014.
Advocate General Siddhartha Shankar Dey told reporters that the petitioner argued that he was not a party to the petition in which the High Court struck down the recruitment rules on the basis of which the appointment was made.
“One of the 10,323 teachers approached the High Court questioning the termination process. The writ petitioner claimed that his services could not have been terminated as he was appointed during the CPI(M) government. .
He came and stated that the government could not have terminated his services without giving him a notice.
The government maintained that they did not kill anyone. Instead, the court ruled that all of them must be terminated because the entire selection process was flawed.
When the new government came in, they promised to solve the problem. They repeatedly approached the Supreme Court seeking extension for the sacked teachers as they were unable to fill all the vacancies of 10,323 sacked teachers.
The Supreme Court granted them a phased extension till March 2020,” he explained.
Day added, “The court emphasized that the petitioner has not advanced any new argument. Moreover, the petitioner has failed to justify his continued employment, even though the recruitment policy of the previous government was upheld by the High Court. and was declared unconstitutional in successive decisions of both the Supreme Court.”
Dey also said that the court imposed a fine of Rs 25,000 on the petitioner for misusing court time.
