New Delhi: The Delhi High Court has rejected the anticipatory bail plea of NSCN-IM leader Alemla Jamir.
Jamir was arrested in 2019 in a terror funding case, which is being investigated by the National Investigation Agency (NIA).
Anticipatory bail cannot be granted in a case which is subsequently noticed and the detention of the accused/appellant cannot be declared illegal merely on the ground that the Clerk of Court raised objections on page numbering and invalid documents etc., and the respondent/NIA had taken some time to respond to the said objections and after removing the objections, notice was duly served on 03.07.2020,” Delhi High Court orders.
It added: “In our view, there is no illegality or infirmity in the orders passed from time to time regarding the detention of the present appellant. Hence, the appeal is devoid of merit and is accordingly dismissed.” ”
The NSCN-IM leader had approached the Delhi High Court on July 3, 2020, after his bail was rejected by a special NIA court.
A special NIA court rejected Jamir’s bail plea saying that the chargesheet was filed within the prescribed period and no basis for statutory bail was made out.
“In our view, it is too late to raise the issue of filing an incomplete charge sheet for the appellant as the case has already progressed and reached a stage where some evidence has already been recorded and This means that the charge sheet is the complete charge sheet filed against the present appellant, hence the question of grant of anticipatory bail does not arise,” said the Delhi High Court.
Jamir was detained by the CISF at the IGI airport on December 17, 2019 for carrying Rs 72 lakh in cash as she could not explain its source.
In his statement to the authorities, Jamir had said that the cash in question belonged to the NSCN-IM.
He said that he received the cash from an associate of NSCN-IM General Secretary Th Muivah at his residence and it was to be handed over to Muivah in Dimapur, Nagaland.
