Assam: The Guwahati High Court has directed the government to pay home guards at par with state police personnel.
GUWAHATI: In a landmark judgment, the Guwahati High Court has directed the Assam government to pay home guards duty allowance at the minimum rate of pay to which police personnel in the state are entitled.
The court while processing a writ petition has asked the state government to complete the exercise within 3 (three) months from receipt of certified copy of the order.
H. Gupta, counsel for the petitioners, argued that 23 states of India have already implemented the judgment of the Supreme Court in Gara Rakshak, Home Guards Welfare Association (supra) till date, however the State of Assam has not implemented it.
The order issued on August 8 by a single bench of Justice Michael Zothankhuma said that in view of the Supreme Court’s decision in the case of Gara Rakshak, Home Guards Welfare Association (supra) to pay home guards duty allowance to the state government. Instruction is given. rates, of which a total of 30 days (a month) comes to the minimum pay to which police personnel in the state are entitled.
Notably, in the said judgment, the Supreme Court noted that since the Home Guards enjoy the powers of policemen in the course of their duty, the State Government should pay them Duty Allowance at the same rates. , which is equal to duty. Minimum 30 days salary of police personnel.
